General Terms and Conditions (GTC)

These General Terms and Conditions apply to all orders and the use of the website LunaSea Coffee – both by consumers and by commercial customers – in the version valid at the time of the order.

1. Scope

These terms and conditions apply to all contracts concluded via the website LunaSea Coffee between the customer and us as the operator.
We only recognize differing terms and conditions of the customer if we have expressly agreed to their validity in writing.

3. Conclusion of the contract

The products presented on our website do not constitute a legally binding offer, but rather a non-binding invitation to place an order .
By clicking the „Order“ button , you submit a binding offer to purchase the items in your shopping cart.
The contract is concluded when we confirm your order or ship the goods .

4. Prices and Payment Terms

All prices are quoted in euros (€) and include the legally applicable value added tax (VAT) .

The customer is only entitled to a right of retention or set-off if his counterclaim has been legally established or is undisputed.

5. Shipping and Delivery Conditions

Delivery within Germany will be made to the address provided by the customer.

6. Right of withdrawal

Consumers have a statutory right of withdrawal .
Detailed information and a sample withdrawal form can be found in our cancellation policy .
Business customers do not have a voluntary right of withdrawal.

7. Retention of title

The goods remain our property until full payment is received .

8. Warranty

The statutory warranty rights apply .
For used goods, commercial customers have a warranty period of 12 months .
Consumers have a statutory warranty period of 24 months .

9. Liability

We are fully liable for intentional acts and gross negligence.
In cases of slight negligence, we are only liable for breaches of essential contractual obligations (so-called „cardinal obligations“) and only for foreseeable, typical contractual damages.

Information on the collection and processing of personal data can be found in our privacy policy .

11. Jurisdiction and applicable law

The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is the registered office of LunaSea Coffee .

12. Final Provisions

Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected .
The place of performance is – to the extent legally permissible – the registered office of LunaSea Coffee.
